A contractual beneficiary is not always an heir
Who receives money outside the estate?
A will can be perfectly drafted while a pension or insurance benefit still follows a separate contractual route.
Start with the situation
The will has been updated, but an insurance payment still follows an old designation.
After a second marriage, Alex and Marina updated their wills and expect Marina to be protected first and the capital to reach the children later.
An old policy names another beneficiary, while pension rights accrued before and after divorce. Those payments may follow provider documents and procedures rather than the estate route.
Main questionWho receives each payment, under which document and when does the money become available?
Cash timetable
A nominal benefit is not first-month liquidity.
The family expects a €1 million life-insurance payment.
- 01Expected benefit
- €1,000,000
- 02Beneficiary
- confirmunder the provider’s current record
- 03Claim documents
- verify
- 04First 30-day cash
- do not assume
The benefit enters the family plan only after beneficiary, procedure and timing have been confirmed.
The example does not determine pension or insurance entitlement.
A contractual beneficiary is not always the same person as an heir under the will.
The Ownership & Beneficiary Inventory connects payments, documents, providers and review dates.
A family plan can contain two different versions of the future
Alex and Marina updated their wills after a second marriage. They believe Marina is protected first and the capital then passes to the children. The file, however, contains an older life policy with a former beneficiary, while pension rights arose before and after a divorce. The will describes one part of the system; provider contracts describe another.
This does not mean the money will necessarily reach the wrong person. It means the route has not yet been confirmed. The relevant pension provider, insurer or other institution confirms the entitlement, amount, timing and procedure under its documents and the rules in force.
Five lines are more useful than ‘my spouse receives everything’
For every pension, policy, annuity or other contractual benefit, record the participant or rights holder, triggering event, current beneficiary, supporting document and person who will contact the provider. Policy numbers and personal identifiers do not belong in an open tool.
Record former partners, children and changes in family status separately. The division of pension rights after divorce and any partner pension depend on the type and timing of the rights, the agreements and the provider’s process. The family map should lead to the provider rather than replace its answer.
A headline amount does not show when cash is available
A €1 million life policy sounds like ready family liquidity. Before an event, however, the family needs to know who may submit the claim, which evidence is required and how the provider processes it. Pension income, a lump-sum benefit and an estate asset also create different cash timelines.
The timing map matters when the family faces a mortgage, living costs, tax or a business-share buyout. A future benefit should not automatically be treated as cash available in the first 72 hours.
The review ends with provider confirmation
Sending an update form is not the final status. Keep the request date, confirmation of the current beneficiary, the responsible person and the event that triggers the next review. Divorce, marriage, a child, a new employer, a pension exchange or a new policy all justify a fresh check.
The inventory shows the notary which payments sit outside the will and shows the tax adviser which amounts and dates require separate modelling. The family receives a verifiable process rather than an assumed outcome.
Public materials
For independent review
These sources help verify the public background to the question. They do not replace a fact-specific review.
Ownership perimeter
An asset value does not yet tell you who owns it.
Relationship rules, source of funds and legal title are considered together. That reveals what actually falls within the estate.

- 03Title
Who is the legal owner
Conclusion after the explanation
For each benefit, identify the rights holder, named beneficiary, triggering event, provider procedure and timing of access.
Signals
Review this if you recognise your situation
- the will was updated but beneficiary nominations were not
- pension, insurance and bank assets are treated as one estate category
- a former partner or children from an earlier relationship are missing from the map
- a future benefit is treated as immediately available without checking the procedure
Next actions
What to do next
- 01create a separate register of pension, insurance and other contractual benefits
- 02request confirmation of the beneficiary and procedure from each provider
- 03reconcile the cash timeline with the will, family costs and business plan
